The arbitration shall be conducted by a mutually agreed-upon arbitration service in accordance with its then-current commercial arbitration rules. The arbitration shall take place in the jurisdiction of Pequod's Pizza's principal place of business, unless the parties agree otherwise in writing.

Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights. Nothing in this Section shall limit either party's ability to file a complaint with applicable regulatory agencies, including the Federal Trade Commission (FTC).

11. Term and Termination

11.1 Term

These Terms of Service shall remain in full force and effect for as long as you use or access the Website or Services, or maintain an account with Pequod's Pizza, whichever is longer.

11.2 Termination by You
